Terms of Service
These terms govern your use of the services provided by BuildAi Agency ("we", "us") at https://mybuildai.agency and its apps. By using the services you agree to them. Fees, plans and any special terms are agreed separately with each client.
1. The services
A marketing platform for businesses: email campaigns and automated follow-ups, AI-written content, chat assistants on WhatsApp, Instagram, Facebook and websites, Facebook and Instagram ad management, a website and product catalogue builder, lead search, visitor tracking and reports. Services are for business use by registered clients only.
2. Your account
You are responsible for keeping your login secure, for everything done under your account, and for the accuracy of the information you give us. Tell us at once if you think someone else has access.
3. Your customers' information
You are responsible for having a lawful basis, and any consent the law requires, for every person you contact or whose information you upload or collect through the platform. Our data processing terms apply to that information and form part of these terms.
4. Acceptable use
You must not use the services to:
- send spam, or email or message people who have asked not to be contacted. Marketing email must include a working unsubscribe, which the platform adds and honours;
- mislead people: fake reviews or testimonials, false claims, or impersonating another person or business;
- break the rules of the platforms we connect to, including the Meta (Facebook, Instagram, WhatsApp) and Twilio policies, including their messaging windows and opt-in requirements;
- send unlawful, harassing, hateful or malicious content, or sensitive personal information;
- attempt to access other people's accounts, probe or overload our systems, scrape the platform, or introduce malicious code into a website we host.
We may suspend or limit an account, or remove content, that breaches this section or puts the platform or other clients at risk, and will tell you why where we can.
5. AI-generated content
The platform uses AI to draft emails, ads, web pages, reports and chat replies. AI can be wrong or inappropriate. You are responsible for reviewing and approving content before it is sent or published, and for how the chat assistant is set up (its business information and answers). Chat assistants identify themselves as AI to the people they talk to; you must not remove or hide that.
6. Third-party platforms
The services depend on Meta, Twilio, Resend, Supabase, Railway, Anthropic and others. Their own terms and policies apply to your use of them, and changes they make (to prices, APIs or rules) can affect the services. We are not responsible for their outages or decisions, though we will help you where we reasonably can.
7. Fees
Fees are agreed in writing between you and us. Unless agreed otherwise they are non-refundable. We may suspend services for accounts with overdue balances after reasonable notice. Ad spend on Meta is charged by Meta to the ad account you connect, not by us.
8. Your content and our software
You keep ownership of your business data, contact lists and content. You give us a limited licence to use them only to provide the services. The platform, its software and our branding remain ours.
9. Availability
We aim to keep the services running but do not promise they will be uninterrupted or error-free.
10. Limits on our liability
To the extent the law allows, we are not liable for indirect or consequential loss, including lost revenue, data or opportunities, and our total liability for any claim is limited to the fees you paid us in the three months before it arose. Nothing in these terms limits liability that cannot lawfully be limited.
11. Ending the relationship
Either of us may end the services with written notice. After that we stop processing your data and, on request, delete or return it within 30 days, subject to any legal obligation to keep it. Sections 3, 8, 10 and 12 continue after the end.
12. Changes and governing law
We may update these terms and will notify active clients of material changes by email; continuing to use the services means you accept them. These terms are governed by the laws of Trinidad and Tobago and disputes go to its courts.
